The Modern Artist Lab, based in Oceanside, California, United States, provides creative education and resources for independent artists. This policy explains how we handle personal information connected with our website, email list, products, and support.
How our services fit together
Squarespace hosts our website and provides website functionality and traffic analytics.
Kit hosts our email opt-in page and helps us deliver requested resources and email communications. The free-playbook buttons on our website lead to Kit.
Whop is our store and hub for purchases, product access, and memberships. Our Squarespace website no longer operates our store.
Meta provides advertising and measurement tools, including Meta Pixel.
Information you provide directly to a platform is also handled under its own policies. This policy covers our handling of information, including information those platforms make available to us.
Information we receive
When you sign up, contact us, or use our services, we may receive your name, email address, form responses, messages, and other information you choose to provide.
For Whop customers, we may receive information needed to support your purchase and access, such as your account or contact details, the product purchased, transaction reference, payment or subscription status, and support requests. Whop and its payment providers collect and process checkout information. We do not directly store complete payment card numbers.
Website and advertising tools may collect technical and activity information, including IP address, browser and device details, approximate location, referring page, pages viewed, link clicks, timestamps, and cookie or similar identifiers. Kit may provide email delivery, open, click, and subscription information; email measurements can be affected by privacy features in your email software.
How we use information
Deliver requested resources, purchased content, and membership access.
Answer questions, resolve access or billing issues, and manage customer relationships.
Send educational content, updates, and offers in line with your signup choices and applicable law.
Understand website and email performance, measure advertising, and improve our content and services.
Maintain security, prevent misuse, keep necessary business records, and meet legal obligations.
Where applicable law requires a legal basis, we rely on consent where required, steps to provide a requested service or fulfill a purchase, legal obligations, or legitimate interests such as security and service improvement, subject to your rights.
Email choices
You can unsubscribe from marketing emails using the unsubscribe link in an email or by contacting us. We may still send necessary service messages about purchases, access, or support. Email signup is not a paid subscription. Unsubscribing from Kit emails does not cancel a Whop membership; manage that membership through Whop.
Meta Pixel, analytics, and cookies
We use Meta Pixel for advertising measurement and related audience features. Depending on the events configured, Meta may receive information about visits and actions, together with device, browser, network, and online identifier information. Meta may associate this information with information it holds and use it under its own privacy policy.
Advertising disclosures or transfers may be treated as “sharing,” targeted advertising, or a “sale” under some privacy laws, even when no money is exchanged for information. Where applicable, you may request to opt out of those uses by contacting us. Use the website’s Cookie Preferences control for the choices available on this site, and review our Cookie Policy for additional controls and their scope.
A choice on this website does not automatically change your preferences on Kit, Whop, Meta, or another website you visit. Those services provide their own privacy controls.
How information is shared
We share information as needed with providers supporting hosting, email delivery, payments, product access, analytics, advertising, and customer support. Providers may process information for us or for their own purposes under their policies. We may also disclose information to meet legal requirements, protect rights and security, prevent fraud, or in connection with a business transfer, subject to applicable law.
If you follow an affiliate or referral link, the destination provider may track the referral. See our Affiliate Disclosure. Information you submit to an external AI tool, software service, or other linked platform is governed by that provider’s practices.
Retention, security, and international processing
We keep information for as long as reasonably needed for the purpose for which it was collected, including delivering services, maintaining necessary transaction records, resolving disputes, and meeting legal obligations. Retention depends on the information and purpose. We may retain records needed to honor an unsubscribe request or comply with law.
We use reasonable safeguards to protect information, but no online service or storage method can guarantee complete security. Please do not send passwords, full payment card details, or sensitive personal information in support messages.
Our providers may process information in the United States or other countries. Where required, applicable transfer safeguards must be used. The laws in those countries may differ from the laws where you live.
Your privacy rights
Depending on your location and the laws that apply, you may have rights to access, correct, delete, or obtain a copy of your information; restrict or object to certain processing; withdraw consent; and opt out of targeted advertising, sale, or sharing. You may also have the right to complain to your local privacy regulator. Withdrawing consent does not affect processing that was lawful before withdrawal.
Send requests to contact@themodernartistlab.com. Tell us which service and email address your request relates to. We may need to verify your identity or an authorized agent’s authority, and legal exceptions may limit a request. We will not discriminate against you for exercising applicable privacy rights. For information held independently by a platform, you may also need to contact it directly.
Children’s privacy
Our website, email list, and educational services are not directed to children under 13, and we do not knowingly collect their personal information. If you believe a child under 13 has provided information, contact us so we can investigate and take appropriate action.
Provider policies and updates
Review Squarespace’s Privacy Policy, Kit’s Privacy Policy, Whop’s Privacy Policy, and Meta’s Privacy Policy for their practices.
We may update this policy as our services or practices change and will provide additional notice where required. The date above identifies the current version. This policy is a notice of our practices; visiting the website does not itself provide consent to optional tracking.
