These Terms govern your use of The Modern Artist Lab website and our educational resources, digital products, and related services. “We,” “us,” and “our” refer to The Modern Artist Lab. By using our website or materials, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use them.

Our website, email list, and Whop hub

Squarespace hosts this website. Whop is our store and hub for product purchases and access. Our free-playbook buttons lead to our Kit email signup page; submitting that form is not a paid purchase and does not create a paid membership.

Whop and Kit provide separate services under their own terms and privacy policies. Product-specific terms and promises shown before purchase form part of that purchase. If those terms differ from these general Terms, the specific offer terms apply to that offer, subject to applicable law and Whop’s platform rules. These Terms do not override your agreement with Whop.

Education and results

Our materials help independent artists develop creative direction, brands, workflows, and business systems. They are educational and informational, and do not replace legal, financial, tax, or other licensed professional advice.

We do not promise revenue, audience growth, streams, recognition, career opportunities, or other specific results. Outcomes depend on your decisions, execution, skills, market, and circumstances. Examples and testimonials are not a promise that you will achieve the same outcome.

Your license to use our materials

Unless a product states otherwise, a purchase or download gives you a limited, non-exclusive, non-transferable license to use the material for your own personal or internal business purposes. You may apply the lessons and resources to your own artist brand, creative projects, and business.

You may not resell, redistribute, publicly upload, republish, or repackage our materials; share paid files or access credentials with unauthorized users; sell modified versions of our resources; or use our protected materials to create a competing commercial product without permission. Buying a product does not transfer ownership of our underlying content or intellectual property.

Original work you independently create remains yours to the extent permitted by law, subject to any third-party rights. Using our resources does not give you ownership of our templates, course materials, or other protected content. Any different license expressly included with an individual product governs that product.

AI and third-party tools

You are responsible for reviewing and fact-checking your work, including AI-assisted outputs, and checking originality, licenses, commercial-use permissions, and platform rules. AI output is not automatically accurate, original, copyright-protected, or cleared for commercial use.

Tools we demonstrate or recommend may have separate fees and requirements. Their providers control their features, availability, terms, and data practices. Review those terms before using a tool or submitting information to it.

Purchases, delivery, and subscriptions

Review the Whop offer and checkout before paying, including what is included, the price and taxes, access duration, required tools, and any recurring billing or trial terms. Provide accurate purchase details and maintain access to the email and account used for your purchase.

Access and delivery follow the purchased offer. If you cannot access a Modern Artist Lab product, contact contact@themodernartistlab.com with your purchase reference. Never send your password or full payment card details.

If an offer is a subscription, manage cancellation through your Whop account. Unsubscribing from our emails does not cancel a paid membership. Refunds and cancellation are explained in our Refund Policy, together with the terms shown for your offer and applicable Whop rules. Changes to future prices or offers do not retroactively change a completed purchase or remove mandatory rights.

Accounts and acceptable use

Keep account credentials and private access links secure. Do not share paid access without permission, bypass access controls, distribute malware, attempt unauthorized access, interfere with services, impersonate others, commit fraud, or infringe another person’s rights.

We may restrict or terminate access for material violations, fraud, or abuse, subject to applicable law and the terms governing your purchase. Provisions that reasonably need to continue after termination, including intellectual property restrictions, remain applicable.

Your submissions

You retain ownership of your original submissions and must have the right to share them. We may use questions and feedback to provide support and improve our services. We will obtain permission before using your name, likeness, or testimonial in marketing, unless otherwise permitted by applicable law.

Affiliate recommendations and privacy

We may receive compensation for qualifying purchases or signups through affiliate or referral links. See our Affiliate Disclosure. A recommendation does not guarantee suitability or results, and other companies handle their own products and purchases.

Availability, warranties, and liability

We work to keep our website and resources available, but interruptions, errors, and third-party outages can occur. To the extent permitted by law, the website and materials are provided “as is” and “as available,” without warranties of accuracy, uninterrupted availability, fitness for a particular purpose, or specific results. This does not override an express product promise or a warranty that cannot legally be excluded.

To the extent permitted by law, The Modern Artist Lab is not liable for indirect, incidental, consequential, special, or punitive damages arising from use of the website or materials. Where a limitation is lawful, our total liability relating to a purchased product is limited to the amount paid for that product. These limitations do not apply to liability or consumer rights that cannot legally be excluded or limited.

Governing law and updates

These Terms are governed by California law, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise. Disputes concerning these Terms may be handled by an appropriate California court unless applicable law requires a different forum. Separate terms governing your use of Whop remain applicable to that service.

We may update these Terms and revise the date above. Material changes will be accompanied by notice where required. Updates do not retroactively remove an existing purchase promise or mandatory rights. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law.
